Diversity in Our Schools: The Shrinking Legal Toolkit

Building a school community that reflects the rich diversity of our world is a goal many educators and administrators share. For our Annual NJ STRIDE Professional Development Conference, our members will get to hear from David Rubin!

His message, "Diversity in Our Schools: The Shrinking Legal Toolkit," is designed to provide a clear and practical understanding of the current legal landscape. The description below outlines the key topics we will cover, offering guidance on what strategies remain legally sound for promoting diversity and inclusion in public schools.

The range of legally permissible strategies for promoting diversity and inclusion in our public schools has narrowed in recent years, and the powers that be in Washington seek to narrow it even further. What measures remain available to school districts that value racial, cultural. sexual and socioeconomic diversity in their students and staff? What practices likely were unlawful long before the current administration came to power? Join veteran school board attorney David B. Rubin for a nuts-and-bolts discussion of the legal framework for diversity and inclusion in the public schools.

David B. Rubin, Esq. is a sole practitioner in Metuchen and of counsel to The Busch Law Group, LLC. A graduate of Duke University and Rutgers Law School, Mr. Rubin represents public school districts and private schools throughout New Jersey, and has litigated numerous precedent-setting cases at all levels of the state and federal court system generating over 50 published judicial decisions. He has served as President of the New Jersey Association of School Attorneys, Chair of the National School Boards Association’s Council of School Attorneys, Chair of the New Jersey State Bar Association’s School Law and Professional Responsibility and Unlawful Practice Committees, and is a frequent lecturer and author in the field of education law and legal ethics.

Mr. Rubin is listed in SuperLawyers Magazine and Best Lawyers in America, holds the AV rating from the Martindale Hubbell Legal Directory, has been recognized by Best Lawyers in America as Lawyer of the Year in the field of legal ethics (Newark Region), and is a Distinguished Service award from the NSBA Council of School Attorneys and the New Jersey Association of School Attorneys. He is also the co-author of The Ethical Educator: Pointers and Pitfalls for School Administrators (Rowman & Littlefield 2022), an acclaimed treatise on resolution of ethical dilemmas facing school superintendents and other administrators.
